III. The method of collecting security deposit from May 31, 2005, when importing unbleached kraft linerboard originating in the United States, Thailand, South Korea and Taiwan, import operators shall provide corresponding security deposit to the customs of the people's Republic of China according to the dumping margin of each company determined in this preliminary determination. the Ministry of Commerce of the people's Republic of China on the anti-dumping investigation of unbleached kraft linerboard products originating in the United States, Thailand Preliminary determination of anti-dumping investigation on Imported Unbleached Kraft linerboard products from South Korea and Taiwan

according to the provisions of the anti dumping regulations of the people's Republic of China, the Ministry of Commerce of the people's Republic of China issued announcement No. 10 on March 31, 2004, deciding to conduct an anti-dumping investigation on Imported Unbleached Kraft linerboard originating in the United States, Thailand, South Korea and Taiwan. The Ministry of Commerce investigated dumping and dumping margin, injury and degree of injury, as well as the causal relationship between dumping and injury. According to the regulations of the people's Republic of China on anti dumping, the Ministry of Commerce made the preliminary determination as follows:

(I) filing

on January 31, 2004, Dongguan Nine Dragons Paper Co., Ltd., Fujian Qingshan Paper Co., Ltd., Shandong Bohui Paper Co., Ltd On behalf of the unbleached kraft linerboard industry in Chinese Mainland, Shandong Sun Paper Co., Ltd. formally submitted an application for anti-dumping investigation against Imported Unbleached Kraft linerboard originating in the United States, Thailand, South Korea and Taiwan. After reviewing the application materials, the Ministry of Commerce believes that the applicant complies with the provisions of Articles 11, 13 and 17 of the anti dumping regulations of the people's Republic of China on the application for anti-dumping investigation by industries in Chinese Mainland, and is qualified to file an application on behalf of the unbleached kraft liner paper board industry in Chinese Mainland, and the application contains Article 14 of the anti dumping regulations of the people's Republic of China Article 15 stipulates the contents and evidence required to initiate an anti-dumping investigation. The Ministry of Commerce of the people's Republic of China issued a filing announcement on March 31, 2004, deciding to start an anti-dumping investigation on Imported Unbleached Kraft linerboard products originating in the United States, Thailand, South Korea and Taiwan. The dumping investigation period of this case determined by the Ministry of commerce is from January 1, 2003 to December 31, 2003, and the industrial injury investigation period (hereinafter referred to as the "investigation period") is from January 1, 2001 to December 31, 2003

(II) preliminary investigation of dumping and dumping margin

1. Notice of filing

on March 23, 2004, the Ministry of Commerce officially notified the embassies of the United States, Thailand and the Republic of Korea in China of the acceptance of anti-dumping investigation applications; For the Taiwan region involved in the case, the Ministry of Commerce, through the Chinese delegation to the WTO, informed the Taiwan region's WTO agency that it had officially received the application for anti-dumping investigation of the unbleached kraft liner industry in Chinese Mainland. On March 31, 2004, the investigating officer in charge of the Ministry of Commerce met with the representatives of the embassies of the United States, Thailand and the Republic of Korea in China, and formally submitted the public part of the filing announcement and the application to him, asking him to notify the relevant domestic exporters and producers. For the Taiwan region involved in the case, the Ministry of Commerce, through the Chinese delegation to the WTO, notified the Taiwan region's WTO agency to file an anti-dumping investigation on unbleached kraft linerboard. At the same time, the Ministry of Commerce informed the applicant of the filing of the case

2. Register to respond to the lawsuit

according to the requirements of the filing announcement, manufacturers and exporters in the above countries and regions should apply to the Ministry of Commerce to participate in the lawsuit within 20 days from the date of the filing announcement of the case. As of the deadline for registration of response to the lawsuit, Mead vishwick, Huihao, stonecontainercorporation, inland paperboard andpackaginginc Georgia pacificcorporation, American International Paper Company, Longwei fiber company, American packaging company and other eight American companies, help Feng Paper Co., Ltd., Xiancheng paper mill Co., Ltd., Taikan Paper Co., Ltd. and Thailand paperboard industry Co., Ltd., and four Thai companies, as well as contractor Paper Co., Ltd., new ocean Paper Co., Ltd., Asahi Paper Co., Ltd., Doolin Paper Co., Ltd., Asia Paper Co., Ltd Seven Korean companies such as Dongri Paper Co., Ltd. and Yueshan Paper Co., Ltd., as well as three Taiwan companies such as yongfengyu Paper Co., Ltd., Rongcheng Paper Co., Ltd. and Zhenglong Co., Ltd., and the American forest and Paper Association registered with the Ministry of Commerce to respond to the lawsuit

3. Enterprise sampling

according to Article 3 of the provisional rules for the sampling of anti dumping investigations, since there are many responding enterprises in the United States and South Korea, calculating the dumping margin for each responding enterprise will bring an excessive burden and hinder the timely completion of the dumping investigation. Therefore, the Ministry of Commerce decided to adopt the sampling method to investigate the responding enterprises in the United States and South Korea respectively. The Ministry of Commerce comprehensively considered the export volume, export amount and other indicators of the respondent enterprises, and decided to take American Huihao company, meadverschwick company, stonecontainercorporation and American packaging company as samples of American companies, and take Doolin Paper Co., Ltd., Co., Ltd. and Yueshan company as samples of Korean companies for dumping investigation

the Ministry of Commerce issued a letter of sampling survey for comments to the respondent enterprises on April 22, 2004. Within the specified time, Doolin Paper Co., Ltd. replied that its products were not within the scope of this investigation. U.S. packaging company and South Korea Co., Ltd. Yueshan also replied to the Ministry of Commerce respectively, stating that due to the wrong statistics of non investigated products, the quantity and amount of exports to Chinese Mainland reported in the original response application form were incorrect, and after reconfirmation, the actual quantity of the investigated products exported to Chinese Mainland during the investigation period was small or the investigated products were not exported to Chinese Mainland. In order to ensure the representativeness of the selected samples, after research, the Ministry of Commerce re selected the American inlandpaperboardandpackaginginc As the sampled enterprises in the United States, Korean Asahi Paper Co., Ltd. and Asiatic Paper Co., Ltd. were re selected as the sampled enterprises in South Korea, and a letter was sent to notify the above three companies, and none of the companies submitted comments. In addition, Georgia pacificcorporation and American International Paper Company also replied to the Ministry of Commerce within the specified time, applying for voluntary submission of replies, and hoping to determine the dumping margin for the company alone

other selected American and Korean enterprises did not express different opinions, and the Ministry of Commerce decided to conduct an investigation according to the final sampling results mentioned above. According to the provisions of Articles 13 and 14 of the provisional rules for sampling in anti-dumping investigations, the dumping margins of the responding exporters and producers that have not been separately examined shall be determined according to the weighted average dumping margins of the selected exporters and producers. When calculating the weighted average dumping margin, zero dumping margin, minor dumping margin less than 2% and the dumping margin calculated according to the facts and the best information available according to Article 21 of the anti dumping regulations of the people's Republic of China are excluded

4. Comments by all stakeholders

during the investigation, relevant stakeholders and their agents, including the American forest and Paper Association and the American respondent company, officials of the Korean Embassy in China, the Korean paper industry federation and related Korean paper enterprises, Taiwan respondent companies, and the applicant of this case, visited the Ministry of commerce respectively, and discussed the scope of the investigated products Comments and relevant evidentiary materials were submitted to the Ministry of Commerce on issues such as product tariff number. The Ministry of Commerce disclosed the above opinions and public materials to all interested parties, and the relevant interested parties submitted comments and defenses to the Ministry of Commerce on the above opinions. The Ministry of Commerce has considered the opinions and comments of the above stakeholders in the preliminary determination according to law

5. Collect evidence

on April 30, 2004, the Ministry of Commerce issued an anti dumping questionnaire to all responding enterprises in Thailand and Taiwan, the United States and South Korea, 1. Enterprises sampled as survey samples and enterprises applying for voluntary responses were required to submit accurate and complete responses within 37 days. During this period, the respondent company applied to the Ministry of Commerce for an extension of time to submit the response within the time limit specified in the questionnaire and stated the relevant reasons. After examination, the Ministry of Commerce agreed to the extension request of the applicant company. 6. Supplementary questionnaire

the Ministry of Commerce conducted a preliminary examination of the response of the respondent company, and issued a supplementary questionnaire to the relevant respondent companies for some parts of the response that were unclear and needed to be explained. Each company submitted supplementary answers within the time required by the supplementary questionnaire. The Ministry of Commerce examined the above-mentioned answer sheet and considered it according to law in the preliminary decision

7. On site inspection

the relevant claims made by Korean enterprises that Korean products should not be included in the scope of this anti-dumping investigation and that the investigation of Korean products should be terminated. In order to verify the authenticity and accuracy of the evidence materials provided by them and make an objective and fair judgment, at the application of Korean enterprises, According to the provisions of the anti dumping regulations of the people's Republic of China and the provisional rules for on-the-spot inspection of anti-dumping investigations of the Ministry of Commerce, the Ministry of Commerce went to South Korea from October 31, 2004 to November 7, 2004 to conduct on-the-spot inspection of the Korean paper industry association and Korean unbleached kraft linerboard manufacturers on the scope of the functional torque tester of the torque tester produced by the investigated company as a precision instrument

in the field inspection, in order to ensure the representativeness of this inspection, the Ministry of Commerce first checked the Korean paper industry association, verified the Korean customs data and the statistical data of the Korean paper industry association, and learned about the manufacturers and exporters of Korean unbleached kraft linerboard. According to the list provided by the Korea Paper Industry Association, the Ministry of Commerce focused on the export volume and physical indicators of products to eight Kraft linerboard manufacturing enterprises in South Korea. There is no way to guarantee its measurement needs.
